emmmm 我該來怎麼說呢？至少我在源中國法律上沒有找到這個東西。
我給你講講抄襲和臨摹的區別，你自己區分吧。
臨摹古人，稱之為學習傳承。這里沒有抄襲問題，只有風格相近或是沒有創新的判斷。
美術創作的借鑒與抄襲是有界限的。其根本區別在於，借鑒不是依樣畫葫蘆般的照抄，而是法乳吸收後脫胎換骨般的變化與成熟，目的不再以因襲為能而是要強調主體「我」的品格；

而抄襲是以掠美充作己出，以博取名利為目的，在形貌與手法上與原作無明顯差別。不同畫家間構圖、形態上基本一致，屬於明顯的抄襲；而有的畫家為了謀利，大批量地自我復制，亦屬於抄襲。
